

TERMS AND CONDITIONS
LAST UPDATE: [20/01/2026]This contract applies to the artist, further referred to as the Seller, and the person or institution, further referred to as the Customer, purchasing from the Seller a work of art, further referred to as the Product. By ordering Product from the Seller, the Customer agrees to the following terms and conditions:PAYMENTS
1. The customer agrees to pay the due amount upfront or half (50/50) for any orders.2. The customer agrees to pay half the invoice total upfront. The other half has to be paid on approval of the initial sketch.3. Any other payment schedule has to be mutually agreed upon before work on the Product commences.4. Customer accepts that work on the Product will not commence until Seller has received payment according to the above schedule.5. Certain types of work do not allow for a split payment. In such cases customer will be informed about this and will be asked to agree on a different payment schedule before any work can commence.PRODUCT DELIVERY
6. Customer agrees that the product will be delivered digitally to the email address provided by Customer, after the final payment has been received by the Seller.7. Any other method of delivery, either digital or physical, has to be mutually agreed upon before the work commences. The customer is obliged to bear any costs incurred by an alternative delivery method, such as postal costs, material costs, digital service subscription fees, etc.8. It is the sole responsibility of the Customer to propose a delivery method which works for both parties. Seller cannot be held accountable for Customer's loss of access to the delivery method, loss of delivered files, impediments such as spam filters or any other technical obstacles outside responsibility of the Seller.
8b. Upon delivery of the product, it is the Customer's responsibility to store it properly. Loss of product due to negligence will not be reimbursed by the Seller. Seller can not guarantee that the original copy of the product will be available in the case that the Customer loses their files.REVISIONS
9. Customer has the right to THREE complete revisions in the sketching phase.10. Customer has the right to a reasonable amount of minor edits before completion, such as changing an eyecolour or fixing a small detail, up to an additional 10% of the total time spent on creating the originally delivered Product. Any requests above that, however minor, will require a prior mutual agreement and will result in a proportional increase of order value. Any such increase will be invoiced separately. Work on any such excessive requests will not commence until the payment for the additional invoice(s) has been received.CURRENCY CONVERSIONS
11. Customer agrees to pay the total amount specified in USD12. It is the sole responsibility of the Customer to bear any currency conversion costs, bank transfer fees, payment provider service fees, and any other costs involved in transferring funds to the Seller.13. Payment is considered as received and completed only when the total amount received on the Seller's USD account is equal to the invoice amount in AUDREFUND POLICY
14. Customer has the right to request a full refund if there has been no progress FROM THE INITIAL SKETCH for three consecutive months, or a partial refund when the Product has not been completed within four months. Refund conditions for commissions which require more work must be agreed separately, before the work commences. (PLEASE NOTE: I am not a full-time artist, so things may be delayed.)15. Customer obliges to contact the Seller in a fast and responsive manner, responding swiftly to any requests for comments, clarifications, opinions, validation of progress, etc. Lack of timely communication on behalf of the Customer will be recognised as implicit approval of all work progress and the current state of the Product.PERSONAL AND COMMERCIAL USE
16. The Product received by Customer is for personal use. Any use of the Product for commercial purposes, reselling it, reproducing or publishing for reasons other than personal purposes has to be approved beforehand by the Seller. This will require a separate agreement between Customer and Seller defining exact conditions and financial implications of such use of the Product. For further questions, please contact the artist.Customer does not hold the right to use the product in any blockchain-related technology, including NFTs, cryptocurrency, or future inventions in the space.In addition, Customer does not hold the right to use the product for AI datasets or for AI tools and any present or future inventions in the space.CANCELLATIONS
17. Seller reserves the right to refuse or cancel any order, under the condition of full refund, without giving reasons to the Customer.18. Any disrespectful behaviour will not be tolerated and may result in the cancellation of the order. Customer will receive a full or partial refund depending on the amount of work completed. Seller will have full right to refuse any service to the Customer in the future.AI USE
19. No AI Training or Machine Learning Use
All artwork, images, illustrations, designs, and creative content produced by me (“the Artist”) are strictly prohibited from being used for training, fine-tuning, improving, or developing artificial intelligence systems, machine learning models, neural networks, or any similar technologies.20. No Data Scraping or Dataset Inclusion
My artwork may not be scraped, copied, indexed, stored, analysed, or included in any dataset—public or private—used for AI, machine learning, or automated content generation purposes, whether commercial or non-commercial.21. No Derivative AI Works
You may not use my artwork to generate derivative works via AI tools, including but not limited to image generators, style-transfer models, or prompt-based systems trained on or referencing my work.22. No Implied Consent
The public display of my artwork does not constitute consent for AI training, data mining, or automated analysis. Any such use without explicit, written permission is considered unauthorised.Ownership & Copyright
23. All Artwork remains the sole intellectual property of the Artist unless explicitly transferred in writing.
24. No ownership, copyright, or authorship is transferred through purchase or license.
25. The Artist retains the right to display, promote, and include the Artwork in portfolios, social media, websites, and promotional materials unless otherwise agreed in writing.License Grant
The license fee is a $100 USD flat rate. This rate can change depending on the complexity and the number of hours worked on the piece/commission.Those who wish to license pre-existing art feel free to contact me through email format26. Unless otherwise stated in a written agreement, the Artist grants the Licensee a non-exclusive, non-transferable, revocable license to use the Artwork under the scope defined at the time of purchase.27. Licenses may include one or more of the following (must be explicitly agreed upon):- Personal use
- Commercial use
- Promotional/marketing use
- Digital-only use
- Print useAny use outside the agreed scope requires prior written permission and may require an additional licensing fee.Prohibited Uses28. The Licensee may not:- Claim the Artwork as their own or remove artist credit where credit is required
- Resell, sublicense, redistribute, or share the Artwork as a standalone product
- Use the Artwork in NFTs, blockchain-based assets, AI training datasets, or generative models
- Modify, trace, or create derivative works without written permission
- Use the Artwork in hateful, defamatory, illegal, or exploitative contentCredit & Attribution
29. Where reasonably possible, the Licensee must credit the Artist as:SUPAYELL (@SUPA_YELL)30. Credit should appear in visible and relevant locations (e.g., description, credits page, or accompanying text).Commercial Use31. Commercial use is not permitted unless explicitly licensed.32. Commercial use includes, but is not limited to:- Monetised content
- Merchandise
- Advertising, marketing, or branding
- Games, films, animations, or published mediaCommercial licenses may be subject to usage limits, duration, territory, and platform restrictions.Payment & Fees33, All fees must be paid in full before delivery of the final Artwork unless otherwise agreed.34. Licensing fees are non-refundable once the Artwork has been delivered.35. Unauthorised use may result in retroactive licensing fees and/or legal actionTermination36. The Artist reserves the right to terminate the license if the Licensee breaches these Terms. Upon termination, all use of the Artwork must immediately cease.Liability & Warranty37. The Artwork is provided "as is" without warranties of any kind.
38. The Artist is not liable for any damages arising from the use or inability to use the Artwork.

1. Read the ToS! The commission form will ask if you have read the ToS.2. Fill out the commission form. It will take me a day or 2 to revise the form and contact you through your preferred method of communication.3. Consultation is then initiated. Please be clear and precise on what you want to commission me: character sheets, pose reference, and mood boards or inspiration are always great, and they'll provide me with a greater visual idea of how you want your characters to be depicted. Through this, I will be starting to draw the initial sketch (this will depend on my availability).4. After the approval of the initial sketch, and both parties are happy, an invoice is issued to the customer. Depending on the price (please refer to the ToS again), you will either be paying half or the full price.5. It may take me a week or 3 to complete the piece, depending on its complexity. During the final clean sketch phase, I will be asking for feedback on whether the customers want any changes (this is further explained in my ToS under "REVISIONS"6. Once the commission is finished, the remaining amount of the fee must be provided before the piece is finalized. I will be sending the email containing the fully rendered and edited piece, depending on the size of the file, it will be given as a zip file or as is.
